A pensioner who sexually assaulted a young woman has been spared jail. Peter Coupe, 76, said he was "disgusted" with himself after committing the offence six times.
But a judge at Caernarfon Crown Court today said the public would be better served if he was punished in the community and attended specialist courses to address his behaviour rather than being sent to prison.
He gave Coupe, of Conwy county, a 36-week prison term, suspended for 18 months. He must do a rehabilitation course and wear an electronic tag during a three-month curfew.
Prosecutor Mark Connor told the court that the victim, who cannot be named, rang police on May 10 last year, reporting that she had been sexually assaulted by the defendant.
There had been several incidents in his home. and on his driveway including where he touched her breasts, kissed her mouth, put his hand down her trousers but not on her intimate area, and also squeezed her bottom over her clothes.
Police arrested the defendant on June 10 last year. He was taken to St Asaph custody suite and interviewed.
He told officers he had been "off-balance" when he touched the victim's breasts "accidentally". He thought she consented to her bottom being squeezed. And he thought she agreed to being kissed but later accepted she had not. He pleaded guilty to six counts of sexual assault.
The victim said she did not feel traumatized but did not want anyone else to go through her ordeal.
Dafydd Roberts, defending, said his client is "disgusted and appalled" by his behavior and apologizes. The judge His Honour Timothy Petts said there was a realistic prospect of rehabilitation and the public would be better served if he were put on a treatment program and punished in the community.
Handing down the suspended prison sentence, he said Coupe must do 50 days of rehabilitation activity and wear an electronically-monitored tag during a three-month curfew ensuring he stays at home between 7pm and 7am. He also imposed a ten-year restraining order not to contact his victim directly or indirectly and meet sex offender notification requirements for ten years.
